Procedural Posture

Judicial Review / Ruling on Contempt Application

  1. 1 Whether the 4th and 13th respondents and their respective officers are guilty of contempt of the court order issued on 21st December 2024.
  2. 2 Whether the alleged contemnors had knowledge of and willfully disobeyed the court order.
  3. 3 Whether the actions taken by the respondents prior to service of the court order constitute contempt.

Ratio Decidendi

The court found that while a valid and unambiguous order was issued on 21st December 2024 and served on some respondents, the ex parte applicants failed to prove that the alleged contemnors had knowledge of the order prior to taking the actions complained of. The 1st contemnor was on official leave and not present at the relevant meeting, and there was no evidence he was aware of the order. The 2nd contemnor was not shown to have been served or aware of the order before the board reshuffle. The 3rd and 4th contemnors acted on directives from the Commissioner for Cooperative Development before the court order was issued. Since contempt requires proof of knowledge and willful disobedience,...

Court Disposition

Application dismissed with costs to the alleged contemnors.

Orders

  • The ex parte applicants’ notice of motion application dated 13th January 2025 is dismissed.
  • Costs awarded to the alleged contemnors in the application and main cause.
