Ratio Decidendi

The court held that the interdiction of the applicants by the Commissioner of Police was lawful and did not breach the rules of natural justice. Under Regulation 23 of the Police Force Regulations (2006), the Commissioner of Police is empowered to interdict an officer if satisfied that public interest requires it, pending disciplinary or criminal proceedings. There is no legal requirement for a police officer to be heard before interdiction. The right to be heard arises only if disciplinary action likely to lead to dismissal is contemplated, in which case Regulation 32 applies. The applicants' claim that their interdiction was void for lack of a hearing was therefore unfounded....
