The court held that, pursuant to Rule 81.10 of the Civil Procedure (Amendment No. 2) Rules, 2012 (England), which is applicable in Kenya by virtue of Section 5 of the Judicature Act, an application for contempt of court must be made within the proceedings in which the judgment or order was made. The applicant's motion for contempt was filed in separate proceedings, not in the original suit where the mandamus order was issued. As such, the application was fatally defective and could not be entertained. The court emphasized that, until Kenya enacts its own procedural rules for contempt, the English rules apply, and the statutory basis for contempt remains Section 5 of the Judicature Act....
