Once a notice of withdrawal of suit is filed pursuant to Order 25 of the Civil Procedure Rules, the suit is extinguished and ceases to exist before the court. The law does not provide for the revocation or setting aside of such a notice, nor for the reinstatement of a withdrawn suit. The applicant's attempt to vacate the notice of withdrawal and revive the judicial review application is therefore without legal basis. The only recourse available to a party who has withdrawn a suit is to file a fresh suit, subject to any legal limitations.
