The court found that the Land Registrar acted outside his statutory mandate by cancelling the Ex parte Applicant's title without giving her notice or an opportunity to be heard, as required by section 79 of the Land Registration Act and the Fair Administrative Action Act. The Registrar's powers to rectify the register do not extend to unilateral cancellation of a registered proprietor's title on grounds of alleged fraud without due process. The law requires that the registered proprietor be served with a 90-day notice and be given a hearing before any rectification affecting their interests is effected.
