The court found that the applicants were awarded only half the costs of the proceedings in the judgment delivered on 6th October 2021. The certificate of taxation issued by the Deputy Registrar erroneously certified the full amount of KES 341,860 instead of half, as decreed. The applicants' application for mandamus sought to compel payment of the full amount, contrary to the judgment. The court held that it cannot allow an illegality to persist and has the power to correct such errors to promote the rule of law.
