The Respondents' admission of liability and invocation of funding shortages did not amount to a valid defence for non-payment. The court held that the Applicant was entitled to an order of mandamus compelling the Respondents to pay the judgment debt and accrued interest, as the government cannot avoid its legal obligations by citing lack of funds once a valid court order exists. The court therefore granted the order of mandamus as sought by the Applicant.
