Ratio Decidendi

The court found that the prosecution's evidence established, on a prima facie basis, all the ingredients of the offence of murder. The accused was found in the same room as the deceased, in possession of a bloody knife, and the postmortem confirmed death by stabbing. There was no other explanation for the cause of death at this stage. The contradictions in room numbers and absence of certain forensic evidence did not, at this stage, negate the prosecution's case. The evidence, if unchallenged, would be sufficient to convict. Therefore, the accused must be put on his defence to explain or rebut the prosecution's case.
