Procedural Posture

Criminal Case / Ruling on No Case to Answer at Close of Prosecution Case

  1. 1 Whether the prosecution established a prima facie case against the accused to warrant being placed on his defence.
  2. 2 Whether the evidence adduced links the accused to the offence of murder beyond reasonable doubt.

Ratio Decidendi

The court found that the prosecution failed to establish a prima facie case against the accused. The only evidence that could have linked the accused to the offence—the knife—was not produced in court, and its chain of custody was broken when it went missing after being sent to the Government Chemist. No witness identified the accused as the perpetrator, and the evidence presented was insufficient to connect him to the murder. The court held that suspicion alone, however strong, cannot substitute for proof beyond reasonable doubt. Consequently, the accused was acquitted under Section 306 of the Criminal Procedure Code.

Court Disposition

acquittal at no case to answer stage
