The court found that although there was eyewitness testimony regarding the stabbing and the fact of death, the prosecution failed to produce medical evidence or a post-mortem report to establish the cause of death beyond reasonable doubt. The absence of such evidence is fatal to a murder charge, as it leaves a critical element of the offence unproven. Consequently, the prosecution did not establish a prima facie case against the accused, and the accused could not be called upon to make a defence. The court therefore acquitted the accused and ordered his immediate release unless otherwise lawfully held.
