Procedural Posture

Criminal Case / Ruling on Objection to Victim Participation at Bond Application

  1. 1 Whether victims have a right to be heard at the hearing of a bail application.
  2. 2 Whether the Law Society, the wife and children, and the parents and siblings of the deceased qualify as victims under the Victim Protection Act.
  3. 3 To what extent victims should be accorded a right of audience by the court at the bond application stage.

Ratio Decidendi

The court held that under the Victim Protection Act and the Constitution, victims—including the Law Society of Kenya, the wife, children, parents, and siblings of the deceased—are entitled to be heard at the bond application stage. Their participation is limited to raising concerns regarding the release of the accused on bond and must not prejudice the accused's right to a fair trial. The objection by the accused to the participation of these victims was found to have no legal basis, as the law provides for victims' views to be considered at appropriate stages of the proceedings, including bond applications, provided such participation does not infringe on the accused's rights.

Court Disposition

objection dismissed

Orders

  • The objection to the participation of the Law Society, wife, children, parents, and siblings of the deceased at the bond application stage is dismissed.
  • Victims, through their advocates, are allowed limited participation at this stage to raise concerns or objections to the release of the accused on bond only.
