Ratio Decidendi

The court found that the prosecution failed to establish a prima facie case against the accused. The evidence of identification was unreliable because the witnesses did not disclose the source of light that enabled them to see the accused at night. Without evidence of adequate lighting, the court could not be satisfied that the accused was properly identified as the perpetrator. The doubts arising from the identification evidence were resolved in favour of the accused. Consequently, the court held that the available evidence was insufficient to require the accused to be put on his defence, and he was acquitted under Section 210 of the Criminal Procedure Code.
