The court found that while the fact and cause of death were established, the prosecution failed to adduce direct or credible evidence linking the accused persons to the murder. The evidence presented was largely hearsay and uncorroborated, with no eye witness called to connect the accused to the offence. The court held that mere suspicion, however strong, is insufficient to sustain a conviction in a criminal case. As such, the prosecution failed to establish a prima facie case against the accused persons, and it would be unreasonable to require them to enter a defence. The court therefore acquitted the accused under Section 306(1) of the Criminal Procedure Code.
