Ratio Decidendi

The court held that once a mistrial is declared, the previous proceedings are nullified and the parties are restored to their original positions. Adopting evidence from a nullified trial would prejudice the accused, as the court would not have the opportunity to assess the demeanor of the witness and the defence would be deprived of a fair trial. Furthermore, the prosecution failed to demonstrate sufficient efforts to secure the attendance of the witness as required under Section 34(1) of the Evidence Act. Therefore, the application to adopt the prior testimony was declined.
