There was no doubt that the deceased died from injuries caused by another person, as confirmed by the post-mortem report. An eyewitness testified to seeing the accused cutting the deceased, and the murder weapon was recovered from the accused's house. There was also evidence of a prior quarrel involving the accused and the deceased's wife. These facts, taken together, provided reasonable grounds to place the accused on his defence as required by section 306(2) of the Criminal Procedure Code. The court therefore ruled that the accused must be put on his defence to answer the charge of murder.
