Legal Issues
- 1 Whether the accused's mitigation as a first offender and his remorsefulness should affect the sentence imposed.
- 2 Whether the circumstances of the offence, including the accused's intoxication and the loss of life, warrant a life sentence or a lesser term.
Ratio Decidendi
The court considered the accused's status as a first offender, his remorse, and his young age as mitigating factors. However, the gravity of the offence, resulting in the loss of life, and the deliberate use of a deadly weapon, even under the influence of alcohol, were aggravating factors. Balancing these considerations, the court determined that a life sentence was not warranted but that a substantial custodial sentence was necessary. Accordingly, the accused was sentenced to 15 years imprisonment.

HIGH COURT CRIMINAL CASE NO 94 OF 2015
REPUBLIC ......................................PROSECUTOR
VERSUS
DENNIS MUTUMA MUTAI..................ACCUSED
S E N T E N C E
1. Having considered the mitigation on behalf of the accused. That he is a first offender. That he is remorseful and of only 28 years.
2. However, a life was lost as a result of his action. The accused may have been under the influence of alcohol but he went for the killer weapon before he dispatched the deceased to his maker.
3. Considering the circumstances of the case and that life sentence is the ultimate sentence. I sentence the accused to 15 years imprisonment.
