The court determined that the substantive issues in the matter arise from disputes over the right to be issued title deeds following a proper survey and subdivision of land, which are matters squarely within the jurisdiction of the Environment and Land Court as established under Article 162(2) of the Constitution. The High Court, by virtue of Article 165(5), is expressly barred from entertaining such matters. Consequently, any further pursuit of the case in the High Court would be an exercise in jurisdictional futility.
