Judicial Review / Ruling on Contempt Application

  1. 1 Whether the 4th Respondent, Radovan Boca, was aware of the court orders issued on 31.8.2017.
  2. 2 Whether the 4th Respondent committed any act or omission in contravention of the court orders of 31.8.2017.

Ratio Decidendi

The court found that the orders issued on 31.8.2017 were directed at the 1st and 2nd Respondents, prohibiting them from issuing a work permit to the 4th Respondent. By the date of the order, the 4th Respondent had already been issued a work permit, and there was no evidence that he had done anything after the order in disregard of it. The court held that the 4th Respondent had not committed any act or omission in contravention of the orders, as the orders did not restrain him from working but only prohibited the issuance of a work permit, which had already occurred. The application for contempt was therefore without merit and dismissed.

Court Disposition
