Ratio Decidendi

The court found that the interim order of stay of attachment granted on 29th June, 2021 was still in force at the time the warrants of attachment were issued and executed. The order had not been set aside or discharged, and its effect was to preserve the subject motor vehicle pending the hearing and determination of the objection application. The respondents, instead of seeking to set aside the interim order, unilaterally proceeded with attachment and execution, which was unlawful. The court held that the attachment was improper and that the objector was entitled to the preservation and release of the motor vehicle. The application was therefore allowed with costs to the respondents.
