Ratio Decidendi

The court held that it is legally untenable to charge an accused person with both aiding and abetting the commission of a crime and, at the same time, failing to report the commission of that very crime. Such charges are mutually exclusive and cannot stand together unless one is framed in the alternative. The charge sheet in this case was therefore incurably defective. As a result, the proceedings based on the plea, the conviction, and the sentence were declared a nullity and set aside. The accused was ordered to be released forthwith, and any fine paid was to be refunded.
