Procedural Posture

Criminal Case / Ruling on Case to Answer After Close of Prosecution Case

  1. 1 Whether the prosecution has established a prima facie case against the accused to warrant putting him on his defence.
  2. 2 Whether the evidence adduced places the accused at the scene and establishes the elements of murder.

Ratio Decidendi

The court found that the prosecution had adduced sufficient evidence to establish a prima facie case against the accused. The evidence placed the accused at the scene of the stabbing, established the identity of the deceased, and provided testimony as to the cause of death. Applying the threshold from Ramanlal Trambaklal Bhatt v R, the court held that a reasonable tribunal could convict if no explanation was offered by the defence. Therefore, the accused was put on his defence in accordance with section 306 of the Criminal Procedure Code.

Court Disposition

Accused put on his defence.

Orders
