The court found that the prosecution proved beyond reasonable doubt that the accused persons jointly assaulted the deceased, causing injuries from which he died. However, the evidence established that the incident occurred after a drinking spree and there was no proof of malice aforethought. The accused and deceased were all intoxicated, and the fatal injuries resulted from a fight rather than a premeditated attack. The court held that the prosecution failed to prove the element of malice aforethought necessary for a murder conviction. Consequently, the accused were found guilty of the lesser offence of manslaughter under Section 202 as read with Section 205 of the Penal Code.
