Procedural Posture

Miscellaneous Application / Ruling on Notice of Motion for Judicial Review (certiorari and Prohibition)

  1. 1 Whether the Land Disputes Tribunal had jurisdiction to cancel or revoke title to land.
  2. 2 Whether the orders of the Tribunal recalling and cancelling the applicant's title were ultra vires and illegal.
  3. 3 Whether the applicant was denied a fair hearing before the Tribunal.

Ratio Decidendi

The Land Disputes Tribunal acted outside its statutory jurisdiction by making orders to recall and cancel the applicant's title to land and by directing the execution of documents for consent. Section 3 of the Land Disputes Tribunal Act restricts the Tribunal's jurisdiction to specific matters, excluding the power to deal with title or its cancellation. As such, the Tribunal's decision was an illegality and a nullity. The High Court therefore granted the orders of certiorari and prohibition as sought by the applicant, quashing the Tribunal's decision and prohibiting the respondents from acting on it.

Court Disposition

Application allowed. Orders of certiorari and prohibition granted. Costs in the cause.
