Procedural Posture

Bail Application / Ruling on Bail Pending Trial

  1. 1 Whether the applicant is entitled to bail pending trial for the offence of murder.
  2. 2 Whether the prosecution has demonstrated compelling reasons to deny bail as required by Article 49 (1)(h) of the Constitution.

Ratio Decidendi

The court found that the prosecution failed to provide any specific facts or circumstances constituting compelling reasons to deny the applicant bail. Merely stating that there is strong circumstantial evidence without elaboration does not meet the threshold required by Article 49(1)(h) of the Constitution. In the absence of demonstrated compelling reasons, the applicant is entitled to bail pending trial. The court therefore allowed the application, imposing conditions to secure the applicant's attendance at trial and to ensure the integrity of the proceedings.
