Procedural Posture

Criminal Case / Ruling on Notice of Motion to Arrest Judgment Before Sentencing

  1. 1 Whether the information (charge sheet) upon which the applicants were convicted was fatally defective and did not disclose an offence which the court had power to try.
  2. 2 Whether the application to arrest judgment under Section 324 of the Criminal Procedure Code was properly before the court and merited.
  3. 3 Whether the particulars of the offence and evidence supported the conviction for murder.

Ratio Decidendi

The court held that the information (charge sheet) upon which the applicants were convicted properly disclosed the offence of murder contrary to Section 203 as read with Section 204 of the Penal Code. The particulars of the offence specified the date and place of the alleged murders and complied with the requirements of Section 134 of the Criminal Procedure Code. The evidence adduced at trial supported the conviction, and there was no defect in the information that would warrant arresting the judgment under Section 324 of the Criminal Procedure Code. The application was therefore without merit and was dismissed.
