Procedural Posture

Criminal Revision / Ruling on Review of Sentence and Conviction

  1. 1 Whether an accused can be charged with both aiding and abetting a crime and failing to report the same crime.
  2. 2 Whether the charge sheet was incurably defective for containing both counts without alternatives.
  3. 3 Whether the proceedings, conviction, and sentence based on such a charge sheet are a nullity.

Ratio Decidendi

The court held that it is legally untenable to charge an accused with both aiding and abetting the commission of a crime and, at the same time, failing to report the commission of the same crime. Such charges are mutually exclusive and cannot stand together unless one is framed in the alternative. The charge sheet in this case was therefore incurably defective. As a result, all proceedings based on the defective charge sheet, including the plea, conviction, and sentence, were declared a nullity and set aside. The accused was ordered to be released forthwith, and any fine paid was to be refunded.

Court Disposition

conviction quashed and sentence set aside

Orders

  • Proceedings, conviction, and sentence are set aside as a nullity.
  • The charge sheet is dismissed for being fatally defective.
