Ratio Decidendi

The court found that the prosecution failed to adduce any evidence linking the accused to the murder of the deceased. The only two prosecution witnesses did not implicate the accused, and one explicitly stated he had not seen the accused on the day in question. No evidence was presented to explain why the accused was charged. As a result, the court held that no prima facie case had been established against the accused. In accordance with the legal standard for a prima facie case and the provisions of section 210 of the Criminal Procedure Code, the accused was found to have no case to answer and was acquitted of the charge of murder.
