Ratio Decidendi

The court found that despite the prosecution's failure to produce a post mortem report, the evidence from the three witnesses was sufficient to establish that the deceased died as a result of injuries sustained on the material night. The judge was satisfied that a prima facie case had been made out against the accused, warranting his being placed on his defence under Section 306(2) of the Criminal Procedure Code. The absence of a post mortem report did not preclude the court from finding that the deceased died from the alleged injuries, as the totality of the evidence presented was adequate at this stage of the proceedings.
