The court found that although the prosecution's evidence suggested the accused stabbed the deceased, the failure to produce a post mortem report meant the actual cause of death was not established. This omission was a critical failure to prove an essential ingredient of the offence of murder. Without proof of the cause of death, the prosecution did not establish a prima facie case against the accused. Consequently, the accused could not be called upon to answer the charge, and an acquittal under Section 210 of the Criminal Procedure Code was warranted.
