Ratio Decidendi

The court found that the Funyula Land Disputes Tribunal acted ultra vires its statutory powers under Section 3(1) of the Land Disputes Tribunal Act by purporting to determine and award substantive beneficial interests in registered land. Such matters fall outside the Tribunal's jurisdiction. Consequently, the Tribunal's decision, as adopted by the Principal Magistrate in Busia Land Case No. 44 of 2010, was unlawful and could not be allowed to stand. The court therefore granted an order of certiorari to quash the impugned decision and its adoption.
