Procedural Posture
Criminal Case / Ruling on Prima Facie Case at Close of Prosecution
Legal Issues
- 1 Whether the prosecution has established a prima facie case against the accused to warrant his being placed on his defence.
- 2 Whether the evidence adduced links the accused to the offence of murder as charged.
Ratio Decidendi
The court found that the prosecution had established a prima facie case against the accused, Gedion Kimutai, for the offence of murder. This finding was based on the testimony of six prosecution witnesses, including four eyewitnesses, whose evidence placed the accused at the scene of the crime. The court was satisfied that the evidence on record was sufficient to require the accused to be put on his defence in accordance with Section 306(2) of the Criminal Procedure Code. The ruling did not address the merits of the defence or make a final determination of guilt, but solely determined that the prosecution had met the threshold to proceed to the next stage of the trial.
