Upon reviewing the evidence adduced by the prosecution, the court found that a prima facie case had been established against the accused, George Kamau Gitau alias Gundu, for the offence of murder. The evidence, if left unrebutted, would be sufficient to support a conviction. Therefore, in accordance with Section 306(2) of the Criminal Procedure Code and the applicable legal principles, the accused was found to have a case to answer and was accordingly put on his defence.
