The court found that the prosecution's evidence was insufficient and tenuous in respect to the 2nd and 3rd accused, as no witness identified them as the attackers and their alibi was corroborated by a witness. Therefore, a prima facie case was not established against them, and they were acquitted under Section 306(1) of the Penal Code. However, in respect of the 1st accused, the prosecution established a prima facie case, and he was required to be put on his defence as there was sufficient evidence connecting him to the circumstances of the offence.
