The only incriminating evidence was hearsay and unsupported by any material witness. There was no evidence connecting the 2nd accused to the crime, and the evidence against the 1st accused was not corroborated. The prosecution did not establish all the elements of the charge of murder, nor did it prove a prima facie case sufficient to put the accused on their defence. Accordingly, the court entered a finding of not guilty under section 306(1) of the Criminal Procedure Code and acquitted both accused persons.
