The court found that both the Githunguri Land Disputes Tribunal and the Nyeri Provincial Appeals Committee acted without jurisdiction in entertaining and determining a dispute concerning ownership of registered land. Section 3(1) of the Land Disputes Tribunal Act restricts the jurisdiction of such tribunals to matters of boundary, occupation, and trespass, and does not extend to ownership of registered land. The applicants were the registered proprietors of the suit land as of 29th December 2009, and any challenge to their title could only be properly brought before the civil courts.
