The court found that the Githurai Land Disputes Tribunal exceeded its jurisdiction by purporting to determine ownership and direct subdivision of registered land, which is outside the scope of Section 3(1) of the Land Disputes Tribunal Act. The tribunal's award and all consequential orders, including the adoption by the Chief Magistrate Court Thika, were therefore null and void ab initio. The applicant was entitled to an order of certiorari quashing the tribunal's proceedings and award, and an order of prohibition restraining the Chief Magistrate Court Thika from issuing any further orders or adopting the tribunal's award.
