Legal Issues
- 1 Whether the prosecution established a prima facie case against the accused for the offence of murder.
- 2 Whether the accused should be called upon to answer to the charge.
Ratio Decidendi
The court found that none of the three prosecution witnesses implicated the accused in the murder of John Ikemer. As a result, there was no evidence upon which the accused could be called to answer. The prosecution failed to establish a prima facie case, and it would be unjust to require the accused to defend himself against an unsubstantiated charge. Consequently, the accused was found not guilty and acquitted under Section 306(1) of the Criminal Procedure Code.
Court Disposition
acquittal
Orders
