The court found that the prosecution failed to establish a prima facie case against the accused. The only eyewitness (PW1) was unable to identify the accused as the perpetrator, and no other evidence, direct or circumstantial, linked the accused to the shooting. The arresting officer (PW2) apprehended the accused based on information from a third party who did not testify, and the firearms evidence (PW3) did not connect the accused to the crime. The court held that there was no evidence, even remotely, implicating the accused in the murder. Therefore, it would be a waste of judicial time to put the accused on his defence when the prosecution had not met the threshold required to do so....
