Ratio Decidendi
The court found that the Community Service Officer's report was favourable and indicated that the appellant was suitable for a community service order. Accordingly, the judge exercised discretion to revise the custodial sentence, substituting it with a community service order to be served at Kampini Primary School for the remainder of the sentence. The decision was grounded in the statutory framework permitting such revision where the offender is assessed as suitable for non-custodial measures.
