Legal Issues
- 1 Whether the accused should be sentenced to imprisonment for the offence of manslaughter after plea bargaining.
- 2 What is the appropriate sentence considering the seriousness of the offence and the social inquiry report.
Ratio Decidendi
The court found that, despite the accused's plea bargain and time spent in custody, the offence of manslaughter is serious, particularly given the familial relationship between the accused and the deceased. The social inquiry report was unfavourable, indicating the accused required significant transformation and had shown a lack of respect for authority. Balancing these factors, the court determined that a custodial sentence of seven years imprisonment was appropriate to reflect the gravity of the offence and the need for deterrence and rehabilitation.
Court Disposition
accused sentenced to imprisonment
Orders
- Accused to serve seven (7) years imprisonment.
