Procedural Posture

Criminal Case / Ruling on Case to Answer at Close of Prosecution Case

  1. 1 Whether the prosecution has established a prima facie case against the accused to require him to be put on his defence.
  2. 2 What constitutes a prima facie case in a murder trial under Kenyan law.

Ratio Decidendi

The court found that the prosecution had adduced evidence placing the accused at the scene of the crime, establishing the death of the deceased, and linking the accused to the assault that resulted in death. Applying the standard set out in Ramanlal Bhatt v R, the court held that a prima facie case had been established against the accused. The evidence, if left unchallenged, would be sufficient to justify a conviction. Therefore, the accused was required to be put on his defence to respond to the case against him.
