The court found that although the fact of death was established, there was no evidence adduced by the prosecution linking the accused to the death of the deceased. The sole witness did not provide any material suggesting the accused's involvement in the causation of death. The prosecution failed to establish a prima facie case as required by law, and therefore, the accused could not be called upon to give a defence. The standard of proof beyond reasonable doubt was not met, and there was no basis upon which the accused could be convicted if he chose to remain silent. Consequently, the accused was acquitted under section 306(1) of the Criminal Procedure Code.
