Criminal Case / Ruling on Sentencing After Plea Bargain
Legal Issues
- 1 What is the appropriate sentence for the accused in light of the plea bargaining agreement and mitigating circumstances?
- 2 Should the period spent in remand custody be deducted from the sentence imposed?
Ratio Decidendi
The court determined that, considering the accused's guilty plea, remorse, status as a first offender, and reconciliation with the victim's family, a custodial sentence of three years' imprisonment was fair and just. The court further held that the period already spent in remand custody (one year, one month, and eleven days) must be deducted from the total sentence, in accordance with statutory requirements. The court balanced the loss of life with the mitigating factors and the wishes of the victim's family, who had forgiven the accused, and concluded that the sentence met the interests of justice.
Court Disposition
Accused sentenced to three years' imprisonment less time served in remand custody.
Orders
- The accused is sentenced to three years' imprisonment, less one year, one month, and eleven days already spent in remand custody.
- Right of appeal within 14 days.

Ruling
1. I have considered the nature of the offence committed herein vis a vis the plea bargaining agreement entered. Accused is remorseful. He is a first offender. He has saved court’s time by pleading guilty. The victim’s family has forgiven him after reconciling. However, the deceased was to blame for the whole incident. Precious life was however lost.
2. I find 3 years (three years) imprisonment fair punishment less 1 year 1 month and 11 days being the period spent in remand custody.ROA 14 days.
