Ratio Decidendi
The court considered the accused's status as a first offender, the absence of a sharp weapon in the commission of the offence, his advanced age, the unclear circumstances surrounding the deceased's presence at the homestead at night, and the period already spent in custody. These mitigating factors warranted a custodial sentence that was not excessive. The court determined that a four-year imprisonment term was appropriate in the circumstances.

CRIMINAL CASE NO. 4 OF 2013
REPUBLIC......................................................................PROSECUTOR
VERSUS
HUSSEIN ABDI KOLO.........................................................ACCUSED
SENTENCE
1. I have considered that the accused is a first offender. He did not use a sharp weapon and appears to be of advanced age. The deceased also went to the homestead at night and it is not clear why he did that. The accused has also been in custody for some time.
2. I sentence him to four (4) years imprisonment.
Dated and delivered at Garissa this 21st day of December, 2018.
