Procedural Posture

Criminal Case / Judgment

  1. 1 Whether the accused caused the death of the deceased by an unlawful act.
  2. 2 Whether the accused had malice aforethought at the time of the offence.
  3. 3 Whether the accused was legally insane at the time of the commission of the offence.

Ratio Decidendi

The court found that the accused was placed at the scene of the crime and that the cause of death was established as a stab wound inflicted by the accused. However, unchallenged medical evidence demonstrated that the accused was suffering from a mental illness at the time of the offence, rendering him legally insane. The court concluded that the accused lacked malice aforethought due to his mental state and was therefore not criminally responsible for murder in the conventional sense. Pursuant to Section 166 of the Criminal Procedure Code, the court entered a special finding of guilty but insane and ordered that the matter be reported to the President for further directions.

Court Disposition

Special finding of guilty but insane; report to the President for directions.

Orders

  • A special finding of guilty but insane is entered against the accused.
  • The case is to be reported to the President for directions as provided under Section 166(1) and (2) of the Criminal Procedure Code.
