The court found that while the evidence established that the deceased died as a result of blunt force trauma inflicted by Administration Police officers at Masogo, the prosecution failed to prove beyond reasonable doubt the identity of the accused as the persons responsible for the assault. The key witness who could have identified the accused was not called, and the prosecution did not provide sufficient evidence to link the accused to the crime. The court held that, in the absence of such identification, a prima facie case had not been established to require the accused to be put on their defence. Consequently, the accused were acquitted under section 306(1) of the Criminal Procedure Code.
