Ratio Decidendi

The court found that the ex-parte applicant's chamber summons seeking leave to apply for judicial review was filed within the statutory six-month period, as the impugned decision was dated 15th June 2022 and the application was filed on 7th December 2022, eight days before expiry of the limitation period. The court held that, since the application was timely and the matter was at the leave stage, leave should be granted to the applicant to institute judicial review proceedings for orders of certiorari and prohibition against the respondents. The substantive motion was to be filed and served within 21 days. Costs were ordered to abide the outcome of the substantive motion.
