Ratio Decidendi

The court found that the Imenti South District Land Disputes Tribunal acted in excess of its jurisdiction by purporting to determine and order the transfer of ownership of land registered under the Registered Land Act. Section 3(1) of the Land Disputes Tribunal Act No. 18 of 1990 (repealed) did not confer jurisdiction to the Tribunal to adjudicate on matters of ownership of registered land. The subsequent adoption of the Tribunal's award by the Magistrate's Court and the issuance of a decree were therefore null and void.
