Ratio Decidendi

The High Court lacks jurisdiction to entertain disputes relating to party list nominations and gazettement of County Assembly members after the publication of the gazette notice. The Supreme Court in Moses Mwicigi & 14 Others v IEBC & 5 Others [2016] eKLR clarified that the entire process of nomination, including gazettement, is part of the electoral process, and any challenge to the outcome must be by way of an election petition before the election court, not through judicial review or constitutional petition. The IEBC's mandate ends upon gazettement, and any further dispute falls within the exclusive jurisdiction of the election court as provided under Section 75 of the Elections Act....
