Ratio Decidendi

The court held that section 21(4) of the Government Proceedings Act expressly prohibits execution by way of attachment and sale of property against government entities, including the Independent Electoral and Boundaries Commission. The applicant's attempt to enforce the decree through a notice to show cause for execution was contrary to both the statute and the prior judgment of the court, which had already declined to grant warrants of attachment and directed that the only available enforcement mechanism was contempt proceedings upon non-compliance with an order of mandamus. The notice to show cause was therefore a nullity and was struck out with costs to the respondent.
